Commission Issues New Rates

The Illinois Workers’ Compensation Commission has posted new benefit rates, based on the recent calculation of the State Average Weekly Wage (SAWW) by the Illinois Department of Employment Security. Section 8 of the Illinois Workers’ Compensation Act sets forth the formulas for determining the minimum and maximum rates to apply for various types of benefits, including TTD, PPD, PTD, amputation, wage differential and death, and the SAWW is used as the basis for calculating these minimum and maximum rates. As the SAWW changes, so change the various rates (at least upward; the rates do not generally decrease).  According to Section 8(b)6 of the Act, the Commission is to post these rates by January 15 and July 15 of each year.
